1. Acceptance of Terms
By accessing or using the services of JPT Jupiter Concrete ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services
JPT Jupiter Concrete provides concrete construction, repair, and related services in Jupiter, FL and surrounding areas. Services include but are not limited to:
- Concrete driveways and patios
- Stamped and decorative concrete
- Pool decks and walkways
- Concrete repair and replacement
- Commercial concrete services
- Other related concrete work
3. Estimates and Pricing
All estimates provided are based on the information available at the time of inspection. Final pricing may vary based on:
- Unforeseen site conditions discovered during work
- Changes requested by the customer
- Adjustments needed for compliance with local building codes
- Material price fluctuations
We will notify customers of any significant changes to pricing before proceeding with the work.
4. Payment Terms
Payment terms will be specified in the project agreement or contract. Typical payment structure includes:
- Deposit: Due upon contract signing
- Progress payments: As specified in the contract
- Final payment: Due upon project completion and customer approval
Accepted payment methods include cash, check, and credit card. Late payments may be subject to additional fees.
5. Scheduling and Timeline
Project timelines are estimates and may be affected by weather conditions, material availability, permit delays, or other circumstances beyond our control. We will make reasonable efforts to complete work within the agreed timeframe and will communicate any delays promptly.
6. Site Access and Preparation
The customer is responsible for:
- Providing clear access to the work area
- Removing personal property and obstacles from the work site
- Ensuring utilities are clearly marked
- Providing access to water and electricity if needed
- Securing pets during work hours
7. Permits and Regulations
Unless otherwise specified in the contract, the customer is responsible for obtaining necessary permits. We can assist with permit applications for an additional fee if requested. All work will be performed in accordance with local building codes and regulations.
8. Warranty
We warranty our workmanship for a period specified in the project contract. This warranty covers defects in installation and workmanship but does not cover:
- Normal wear and tear
- Damage from improper use or maintenance
- Damage from freezing temperatures or extreme weather
- Settling of the ground beneath the concrete
- Damage from vehicles or heavy equipment
- Natural variations in concrete color and texture
9. Changes and Cancellations
Changes to the project scope must be requested in writing and will be subject to additional charges. Cancellation policies:
- Cancellations made more than 48 hours before scheduled work: Full deposit refund minus administrative fee
- Cancellations made less than 48 hours before scheduled work: 50% deposit refund
- Cancellations after work has begun: No refund, full payment due for work completed
10. Liability
We carry full liability insurance and workers' compensation coverage. We are not responsible for:
- Pre-existing damage to the property
- Damage to underground utilities not properly marked
- Damage resulting from natural disasters or acts of God
- Consequential or indirect damages
11. Customer Responsibilities
The customer agrees to:
- Provide accurate information about the project site
- Disclose any known issues with the property
- Make timely payments as agreed
- Inspect completed work promptly and notify us of any concerns
- Maintain the concrete as recommended
12. Dispute Resolution
Any disputes arising from these terms or services provided will be resolved through:
- Direct communication with our management team
- Mediation if direct resolution is not achieved
- Binding arbitration if mediation is unsuccessful
All disputes will be governed by the laws of the State of Florida.
13. Intellectual Property
All designs, plans, and materials created by JPT Jupiter Concrete remain our intellectual property unless otherwise agreed in writing. Customers may not reproduce or distribute our designs without permission.
14. Photography and Marketing
We may photograph completed projects for marketing purposes. If you prefer that your property not be photographed or used in marketing materials, please notify us in writing before work begins.
15. Safety
We maintain strict safety standards on all job sites. Customers and visitors should stay clear of active work areas. The work site will be marked with appropriate safety signage.
16. Environmental Compliance
We dispose of all materials in accordance with local environmental regulations and will make reasonable efforts to minimize environmental impact during our work.
17. Force Majeure
We are not liable for delays or failure to perform due to circumstances beyond our reasonable control, including natural disasters, extreme weather, labor disputes, material shortages, or government actions.
18. Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
19. Modifications to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Continued use of our services constitutes acceptance of modified terms.
